In order to decide if mediation is the right process for you, consider the following: Mediation is a voluntary process in which persons or organizations involved in a dispute or controversy attempt to find commonality and address their differences with the assistance of a neutral facilitator. The mediator ensures that the parties are provided an opportunity to explain their concerns, and assists the parties as they attempt to generate solutions to their problems. Mediation differs from other forms of dispute resolution, such as litigation, in that there is no judge, decision or award. The only solutions arising from mediation are those agreed upon by the parties themselves. Our mediators will bring the parties together to meet and discuss the issues. We do not tell you what to do. Instead, we listen and attempt to help you discover and agree upon your own solutions. We are neutral, and keep your confidences secret. Mediations can be of varied durations, but typically consume 2-8 hours. Compared to the alternative of litigation, mediation is an excellent value. We charge for our mediators on an hourly basis, with various rates, depending on their experience. Currently, our mediators charge between $150 and $250.00 per hour. In our experience, each party typically pays a fair share of the fee. The first two hours’ fee is non-refundable, and must be deposited with us in advance. The remainder of the fee must be paid on the day of service, at the conclusion of that day’s session. Do you want to be the one to decide your case instead of a judge or other decision maker?
